America’s Cup – New York – Con una lettera scritta oggi al giudice Kornreich della Suprema Corte di New York, che fa seguito agli infruttuosi colloqui con il Golden Gate Yacht Club, il defender dell’America’s Cup, la Société Nautique de Genève, ha confermato che organizzerà il Deed of Gift Match con il Golden Gate Yacht Club a febbraio 2010 a Valencia, che sono la località e le date ripetutamente richieste dal Challenger e già in precedenza stabilite dalla Corte.

La Société Nautique de Genève ha inoltre espresso la sua intenzione di pubblicare il Bando di Regata della 33ma America’s Cup con effetto immediato.

In seguito alla decisione della Suprema Corte di New York, secondo la quale Ras Al Khaimah negli Emirati Arabi (prima scelta di Société Nautique de Genève come sede per l’evento) non è valida perchè non conforme al Deed of Gift, il defender ha proposto due soluzioni alternative nell’Emisfero Sud: Proserpine/Aerlie Beach e Townsville in Australia. Si tratta di località dove le condizioni meteo in febbraio sono quelle ideali per lo svolgimento della sfida.

La reazione del Golden Gate Yacht Club è stata quella di cercare di ritardare lo svolgimento della Coppa, cercando di trarre vantaggi in termini di competitività, mentre SNG partecipa alle riunioni in buona fede con l’obiettivo di trovare una soluzione.

Société Nautique de Genève conferma dunque Valencia come sede per la 33ma America’s Cup a febbraio del 2010. L’offerta al Golden Gate Yacht Club per una sede australiana nelle stesse date rimane sul tavolo fino 13 novembre 2009, a patto che il Golden Gate Yacht Club accetti di ritirare ogni azione legale.

Brad Butterworth, skipper di Alinghi, che ha partecipato alle trattative a New York, ha espresso il suo disappunto per il risultato dei colloqui: “Abbiamo preso parte ai meeting in buona fede, pronti a fare concessioni nell’ottica di garantire il ritorno della Coppa in acqua a febbraio, per un duello tra due multiscafi che rappresentano lo stato dell’arte. Ancora una volta devo sottolineare il fatto che BMW Oracle Racing ha partecipato con modalità tese esclusivamente a soddisfare i suoi interessi. Questa volta la loro priorità era quella di ritardare lo svolgimento della regata perchè non sono pronti. Originariamente sono stati loro a insistere per febbraio 2010, quando questo era ancora un vantaggio a loro favore. Ora devono accettare quella che è stata la loro stessa prima scelta. Credo di parlare veramente a nome di tutti quando dico che vogliamo che la Coppa torni il più presto possibile in acqua”.

Estratto della lettera inviata al giudice Kornreich il 10 Novembre:
“A questo punto, dopo aver proposto diverse località al Golden Gate Yacht Club, Société Nautique de Genève crede che la 33a America’s Cup debba essere decisa a febbraio 2010, sull’acqua piuttosto che avanti alla Corte dello Stato di New York. Con la pubblicazione del Bando di Regata per disputare l’evento a Valencia nel febbraio 2010, Société Nautique de Genève rispetta: (a) la sentenza di questa corte ‘riportata in essere’ dalla decisione della Corte d’Appello del 2 Aprile 2009, nella quale si ordina che le parti gareggino a febbraio 2010, stabilendo, nello stesso tempo, che Valencia sia una delle possibili località dove disputare la 33a America’s Cup e (b) la direttiva di Vostro Onore secondo la quale ‘…Société Nautique de Genève deve organizzare l’evento a febbraio come stabilito dalla Corte d’Appello e dal giudice Cahn’”.

AMERICA’S CUP, ALINGHI READY TO RACE IN VALENCIA IN FEBRUARY 2010
[Alinghi Press Release] In a letter written today to New York Supreme Court Justice Kornreich following the unsuccessful discussions with the Golden Gate Yacht Club, the America’s Cup Defender, Société Nautique de Genève, has confirmed that it will conduct a Deed of Gift Match with Golden Gate Yacht Club in February 2010 in Valencia, which is the date and venue repeatedly requested by Golden Gate Yacht Club and previously ordered by the Court. Société Nautique de Genève has also expressed its intention to publish the 33rd America’s Cup Notice of Race with immediate effect.

When Société Nautique de Genève’s first choice of venue, Ras Al Khaimah, UAE, was declared invalid by the New York Supreme Court, the Swiss Defender proposed two alternative Southern Hemisphere venues: Proserpine/Airlie Beach and Townsville in Australia, where the weather conditions are suitable in February.

Golden Gate Yacht Club’s reaction has been to try to delay the Cup and to continue to try and gain competitive advantage while Société Nautique de Genève attended the meetings in good faith with the objective of finding a settlement.

While Société Nautique de Genève confirms Valencia as the venue for the 33rd America’s Cup in February 2010, the offer to Golden Gate Yacht Club of an Australian venue for the same date remains on the table until 13 November 2009 provided Golden Gate Yacht Club agrees to withdraw all legal actions.

Alinghi skipper, Brad Butterworth, who participated in the discussions in New York, expressed his disappointment at the outcome: “We went into the talks in good faith, ready to make concessions in order to guarantee the return of the Cup to the water for a February duel between two state of the art multihulls, but sadly once again BMW Oracle Racing were in power grab mode. This time their priority was to delay the race because they are not ready. Originally they pushed for February when it was to their advantage; now they have to live with their choice of date. I think I speak for the community when I say we want the Cup sorted out as soon as possible on the water.”

Extract from Société Nautique de Genève’s letter to Justice Kornreich sent 10 November:
“At this point, after proposing various venues to Golden Gate Yacht Club, Société Nautique de Genève believes that the 33rd America’s Cup must be decided in February 2010 on the water rather than in the Courts of New York State. In issuing its NOR for races in Valencia for February 2010, Société Nautique de Genève complies with (a) this Court’s Order, ‘reinstated’ by the Court of Appeals’ April 2, 2009 decision, that the parties race in February 2010, and authorizing Valencia as a permissible venue for the 33rd Cup, and (b) Your Honor’s direction that ‘Société Nautique de Genève [] hold the race as per the order of the Court of Appeals and Justice Cahn in February.’”
