Volvo Ocean Race - Singapore - La Giuria Internazionale della Volvo Ocean Race ha respinto la protesta presentata dal Comitato di Stazza contro Ericsson 4, in quanto, secondo i giudici, il team di Torben Grael non era obbligato ad informare gli stazzatori dei lavori effettuati sulla prua della barca.

La decisione della Giuria, presieduta da Bryan Willis, chiude quindi il caso sollevato dal Rule Management Group lo scorso sabato pomeriggio. Mentre girava lungo le banchine di Singapore, il Capo Stazzatore aveva notato una sezione di prua appoggiata vicino ai container del consorzio svedese. Appreso che la stessa, danneggiatasi durante le operazioni di armamento, era stata rimossa da Ericsson 4 e sostituita con una nuova sezione ottenuta dallo stampo originale prima della partenza da Alicante, James Dadd aveva presentato una protesta contro il VOR 70 di Torben Grael, reo, a suo dire, di non aver dato comunicazione dell’intervento agli organi preposti. Oltre a non informare gli stazzatori dei lavori effettuati, lo shore team dell’Ericsson Racing Team aveva duplicato i riferimenti utilizzati dai tecnici della Volvo Ocean Race per effettuare le misurazioni, operazione che avrebbe potuto rendere nullo il certificato di stazza della barca.

Durante l’udienza, lo skipper Torben Grael si è detto dispiaciuto per la mancanza di comunicazione tra il suo team e il Rule Management Group, ma ha insistito sul fatto che, ai sensi del Regolamento di Classe, l’Ericsson Racing Team non era obbligato a dare notizia dei lavori effettuati agli stazzatori.

La Giuria Internazionale è stata d’accordo con le agomentazioni dello skipper brasiliano: “Le argomentazioni del Rule Management Group erano limitate al fatto che Ericsson 4 era tenuto a informarlo della sostituzione della sezione di prua e, non avendolo fatto, ha infranto la regola 3.1 del Regolamento di Classe. Va altresì sottolineato che, come ammesso dal Rule Management Group, la nuova sezione di prua è del tutto identica a quella rimossa e il posizionamento dei riferimenti utilizzati per effettuare le misurazioni non rappresenta un problema. Tenendo conto di tutto ciò, la Giuria ritiene che Ericsson 4 non fosse tenuto ad informare gli stazzatori dei lavori effettuati. La protesta è perciò respinta. La giuria condivide l’opinione di Ericsson 4 secondo la quale è prassi comune informare il Rule Management Group per ogni modifica del genere perché, non facendolo, si corre il rischio di infrangere altre regole. Durante l’udienza, il Rule Management Group ha scelto di non procedere su altri punti della protesta scritta”.

VOLVO OCEAN RACE, ERICSSON 4 COMES OUT CLEAN
[Volvo Ocean Race Press Release] Ericsson 4 will not be penalised under the protest filed by the Rule Management Group against the team. The International Jury found the team was not obliged to inform the Measurers of changes made to the bow of its boat, and therefore the team had not broken a rule.

This past weekend, the Rule Management Group (RMG) of the Volvo Ocean Race, the group responsible for the management of the Volvo Open 70 Class Rule and the measurement of the race fleet, submitted a report to the International Jury. The submission concerned the bow of Ericsson 4, the current leader of the Volvo Ocean Race.

On Saturday, the Chief Measurer came across a foam-built false bow section of a boat in Ericsson Racing Team (ERT) colours near the ERT containers. This was an old bow section from Ericsson 4 which, following damage well before the race started last year, was removed and replaced with a new bow section made using the same mould. The old bow section was kept as a spare part and loaded into the team’s shipping containers.

Ericsson Racing Team did not inform the measurers that they had replaced the sacrificial bow section and ‘duplicated’ the position of the measurement reference point with another screw head, something that may have affected the accuracy of the hull measurement data. During the hearing, skipper Torben Grael said the team ‘regretted’ the lack of communication to the Rule Management Group about this change. He also made an emotional appeal about the pressure he was under due to this protest. But he insisted his team was not obliged under the Class Rule to communicate this to the Measurers.

The International Jury agreed. In it’s ruling, the Jury found: “the Rule Management Group’s assertion was limited to: “(a) a claim that Ericsson 4 was required to inform the Race Management Group of the changed bow section; (b) the rule breached was Volvo Open 70 Rule (Version 2) 3.1 and no other rule; (c) acceptance by the Rule Management Group that the new bow section was the same as the replaced section, and that the position of the measurement reference point was not an issue. On that basis, the Jury finds there was no obligation for Ericsson 4 to inform the Rule Management Group of the change. The protest is therefore dismissed. The jury endorses Ericsson 4’s opinion that it is normal practice for teams to inform the Rule Management Group of any such changes. Not to do so risks breaching other rules. During the hearing, the Race Management Group chose not to proceed with the other aspects of the written protest.”
