“Con una mossa che ha sorpreso anche i più attenti osservatori dell’universo Coppa America, il New York Yacht Club ha presentato un amicus Curiae davanti alla Corte d’Appello dello Stato di New York in sostegno delle ragioni del Golden Gate Yacht Club.

Il club che sorge sotto il Golden Gate è il sodalizio per il quale regata BMW Oracle Racing, il team di Larry Ellison. Dopo aver vinto la causa di primo grado davanti alla Corte Suprema dello Stato di New Yorkb con la quale contestava la nomina a Challenfer of record del Club nautico Espanol de Vela, il Golden gate Yacht Club ha visto la decisione ribaltata dalla Divisine d’Appello e ha decisio di impugnare quest’ultima sentenza.

Mentre altri yacht club meno noti, iscritti alla 33ma America’s Cup, hanno presentato i loro Amicus Curiae in appoggio alle tesi della Société Nautique de Genéve  e Alinghi, il documento depositato dal sodalizio newyorkese pare aver ben altro peso.

Per cominciare, il New York Yacht Club non è parte in causa, né in caso di un evento multi-challenger, né in caso di un duello uno contro uno sui multiscafi. Ancor più importante è il fatto che il New York Yacht Club ha difeso la Coppa America per 132 anni, dal 1851 al 1983, ed è per questo che viene considerato come uno dei bastioni della Coppa America, anche in tempi in cui, come oggi, non è tra gli iscritti. A ciò si aggiunge poi la forza delle argomentazioni presentate dal club.

Nonostante fosse rimasto sino ad oggi fuori dalla disputa legale, il suo Brief non lascia dubbi circa il supporto dato alle tesi del Golden Gate Yacht Club. Una posizione in netto contrasto con quella espressa dagli avvocati della Société Nautique de Genéve, che da per implicito l’appoggio alle argomentazioni del defender da parte del New York Yacht Club.

Sollecitando il tribunale a riformare la sentenza di secondo grado, l’Amicus Curiae chiede ai giudici di ritenere non valida ai sensi del Deed of Gift la sfida presentata dal Club Nautico Espanol de Vela che, pertanto, non può essere un valido Challenger of record per la 33ma America’s Cup. Si tratta di una condanna ferma e decisa contro tale nomina che, secondo i commentator, potrebbe aver un peso decisivo sulla corte.

La decisione di ribaltare la sentenza di primo grado, favorevole al Golden Gate Yacht Club, è stata molto sofferta. La Divisione d’Appello della Suprema Corte dello Stato di New York si è infatti espressa a favore della Société Nautique de Genéve con una maggioranza di tre voti contro due, e a votare contro sono stati i due giudici più anziani. Toccherà ora alla Corte di Appello decidere se si può trascurare l’opinione di un club così prestigioso.

L’udienza per l’esposizione delle argomentazioni orali è previsto per 10 febbraio e la sentenza è attesa verso la fine di marzo o per i primi di aprile. Sarà questa la decisione definitiva, poichè contro di essa non sarà possibile presentare alcun ricorso”.


NEW YORK YACHT CLUB NAILS COLOUR TO MAST

“In a move that has surprised even experienced America’s Cup watchers, the New York Yacht Club has filed an amicus curiae (“friend of the court”) brief with the Appeal Court in New York, supporting the arguments of the Golden Gate Yacht Club.

San Francisco-based Golden Gate is the club under which Larry Ellison’s BMW Oracle races. It successfully challenged, in the New York Supreme Court, the validity of the Spanish Club Nautico Espanol de Vela (CNEV), which is the current Challenger of Record. That decision was, however, overturned by the Court’s Appellate Division and now Golden Gate is, in turn, appealing that decision.

While other yacht clubs, notably lesser-known entities who have signed on with Societe Nautique de Geneve (SNG) and Alinghi for the next America’s Cup in Valencia, have also filed Amicus Curiae briefs (not surprisingly supporting the current defender), the filing from New York is in a whole different class.

For a start, the New York Yacht Club is not an interested party in any of the proposed America’s Cup races (either Alinghi‘s proposed multi-challenger event or BMW Oracle‘s head to head battle in giant multihulls).

Perhaps even more importantly, the New York Yacht Club was the holder of the America’s Cup for 132 years (from 1851 to 1983). It is, therefore, often regarded as the “bastion” of the America’s Cup, even in times, like the present, when it is not actually a participant. Perhaps as surprising as the filing is the strength of the club’s arguments.

Although it has, until now, remained largely silent on the ongoing courtroom dramas, its brief leaves absolutely no doubt about its support for the arguments advanced by Golden Gate. This is in stark contrast to the brief filed by SNG’s lawyers, which implied that the New York club supported the defender’s position.

Urging the court to reverse the decision of the Appellate Division, the brief asks the judges to hold that the challenge submitted by CNEV was invalid under the Deed of Gift governing the America’s Cup and that CNEV is, therefore, ineligible to act as the Challenger of Record in the 33rd America’s Cup.

It is a strongly worded condemnation of the appointment of CNEV as challenger and experienced America’s Cup commentators are predicting it could weigh heavily on the court.

The decision to overturn the original ruling, which was in favour of Golden Gate, was close. The Appellate Division of the New York Supreme Court ruled in SNG’s favour by a 3-2 majority, with the court’s two most senior members dissenting from the majority decision.

As well as weighing all the other arguments, the Appeal Court of New York will now have to decide whether it can overlook the view of a club of such standing.

The full hearing of the appeal will be on February 10, with a decision expected in late March or early April. This decision will be final as no further appeals are allowed.”
