[singlepic=759,170,250,,left] America’s Cup – San Diego – All’indomani del secondo meeting tra Alinghi e i challenger regolarmente iscritti alla 33ma Coppa America torna a parlare Tom Ehman, portavoce di BMW Oracle Racing, e lo fa a mezzo comunicato stampa:

“E’ un vero peccato che noi – e Mascalzone Latino – siamo stati esclusi dal meeting organizzato ieri da Alinghi a Ginevra per discutere delle regole della 33ma America’s Cup, but siamo soddisfatti di alcune novità che riteniamo piuttosto positive.
Per esempio, plaudiamo alla decisione che porterà alla nomina di ufficiali di regata, di un Direttore Tecnico e di umpires riconosciuti dall’ISAF. Si tratta di un eccellente passo nella giusta direzione.
Ma rimane ancora irrisolto il problema prioritario dell’Arbitration Panel. Aggiungendo due membri si è semplicemente dato ad Alinghi un vantaggio di tre a due invece che di due a uno. La procedura standard per la nomina dei componenti dovrebbe consentire agli sfidanti e al defender di scegliere due membri ciascuno, mentre il quinto dovrebbe essere nominato sulla base del consenso comune. Questo sarebbe ‘fair’.
Inoltre, altri punti restano da chiarire, come il fatto che il defender, tramite AC Management (società controllata da Ernesto Bertarelli), può cambaire le regole come vuole e può imporne di nuove, introducendo restrizioni svantaggiose per gli avversari.
La nostra posizione sulla 33ma America’s Cup resta chiara: rinunceremo all’azione legale se Alinghi adotterà regole giuste e competitive”.


TOM EHMAN: “WE’LL DROP OUR LAWSUIT IF ALINGHI ADOPOTS FAIR RULES”
[BMW Oracle Racing Press Release] It’s unfortunate that we – and Mascalzone Latino – were excluded from the meeting hosted by Alinghi in Geneva yesterday to discuss proposed rules for AC33, but we are heartened by some positive things that came out of the meeting.
For example, we applaud their decision to have the America’s Cup Race Officials, the Technical Director and Umpires be selected from ISAF officials. This is an excellent step in the right direction. But a major sticking point remains the arbitration panel. Adding two members simply gives Alinghi a 3-2 advantage rather than their previous 2-1 advantage. Standard operating procedure for selecting an arbitration panel is to have the challengers pick two members, the defender pick two, and those four individuals agree on a fifth member. That would be fair.
In addition, other fundamental fairness issues remain to be addressed, including the fact that the defender, through ACM (the management company controlled by Ernesto Bertarelli), can change any of the rules at any time and can impose any new rule or restriction on the competitors.
Our position on AC33 remains clear: we will drop our lawsuit if Alinghi adopts fair and competitive rules.
