America’s Cup, Alinghi commenta la nuova mossa di BMW Oracle Racing

[singlepic id=4191 w=300 h=204 float=left]America’s Cup – Valencia – Mentre Brad Butterworth, skipper di Alinghi, insieme ai rappresentanti della Société Nautique de Genève, partecipava a Singapore, al meeting per risolvere le controversie ancora in essere in vista dell’inizio delle regate della 33ma America’s Cup, prevista per l’8 febbraio prossimo, in presenza anche di David Tillett, presidente della Giuria dell’America’s Cup nominata dall’ISAF e di David Kellett rappresentante dell’ISAF stessa, BMW Oracle Racing ha abbandonato unilateralmente le trattative e ha presentato la sua nona causa legale di fronte alla Suprema Corte di New York, nel tentativo di squalificare il Defender dall’imminente confronto in mare.
“BMW Oracle Racing è già riuscito a eliminare 18 team attraverso il sistema giudiziario americano per guadagnare l’accesso diretto alla finale dell’America’s Cup. Ora stanno cercando di vincere la Coppa senza aver mai regatato – ha dichiarato Brad Butterworth – Quest’ultima azione legale arriva come uno shock proprio nel momento stavamo pianificando un altro incontro per finalizzare tutti gli argomenti affrontati oggi e ciò dimostra la loro assoluta cattiva fede. Chiaramente non sono pronti per regatare. Hanno inoltre completamente ignorato la giurisdizione della Giuria dell’America’s Cup nominata dall’ISAF, giuria che loro stessi avevano fortemente caldeggiato, e si sono ripresentati davanti alla Corte di New York, dove chiaramente pensano di avere maggiori possibilità di successo” ha aggiunto.
L’imbarcazione del Defender è stata costruita in Svizzera nel pieno rispetto di quanto previsto dal Deed of Gift. Société Nautique de Genève non concorda con l’interpretazione del Golden Gate Yacht Club.
La dichiarazione di BMW Oracle Racing secondo cui Alinghi utilizzerà vele realizzate negli USA è sbagliata. Le vele per partecipare all’America’s Cup sono state costruite in Svizzera in una veleria a Villeneuve. Inoltre il procedimento 3DL per la realizzazione di queste vele è protetto da diritti di proprietà intellettuale svizzeri. Gli inventori di questo procedimento di costruzione, Jean Pierre Baudet e Luc Dubois, sono due ingegneri svizzeri. Tutti i challenger e i defender dal 1995 hanno sempre utilizzato vele in 3DL di tecnologia svizzera.
“Il tentativo di BMW Oracle Racing di far deragliare l’America’s Cup, di ignorare la giurisdizione dell’ISAF e il comportamento antisportivo sono inaccettabili” ha dichiarato Fred Meyer, vice commodoro di SNG – Alinghi è pronto a regatare l’8 febbraio come ordinato dalla sentenza del 7 aprile 2009: abbiamo guadagnato il diritto di difendere l’America’s Cup sull’acqua vincendo la 31ma e la 32ma edizione. Vogliamo tornare a regatare, non vogliamo che il risultato dell’America’s Cup sia determinato dalla Corte di New York”.
AMERICA’S CUP, BMW ORACLE RACING SEEKS TO DISQUALIFY ALINGHI AND TO WIN THE AMERICA’S CUP IN COURT
[Société Nautique de Genève Press Release] While Brad Butterworth, Alinghi skipper and Société Nautique de Genève representative, was in Singapore engaged in good faith discussions to resolve remaining issues ahead of the 8 February America’s Cup Deed of Gift Match in the presence of David Tillett, the chairman of the ISAF America’s Cup Jury, and David Kellett, the ISAF representative, BMW Oracle Racing unilaterally aborted talks by filing their ninth lawsuit against the Société Nautique de Genève at the New York Supreme Court seeking to disqualify the Defender from the upcoming Match.
“BMW Oracle Racing has already successfully disqualified 18 teams through the US courts to gain access to the Match, now they are seeking to win the Cup without ever racing for it,” said Brad Butterworth. “This latest lawsuit has come as a shock given we were planning a further meeting to finalise discussions today, it demonstrates extreme bad faith. Clearly they are not ready to race. They have completely disregarded the jurisdiction of the ISAF America’s Cup Jury, which they sought so hard to have instated, and have instead reverted to the New York courts where they clearly feel they have a greater chance of success,” he added.
Société Nautique de Genève’s defending yacht has been constructed in Switzerland in compliance with the provision of the Deed of Gift. Disagrees with Golden Gate Yacht Club’s interpretation.
BMW Oracle Racing‘s statement that Alinghi will be using USA-made sails is wrong. The sails for the Match have been constructed in a sail loft in Villeneuve, Switzerland. Furthermore, the 3DL process of making sails is subject to Swiss intellectual property rights. The inventors of the process, Jean-Pierre Baudet and Luc Dubois, are two Swiss engineers. Every challenger and defender for the America’s Cup since 1995 has used 3DL Swiss technology based sails.
“BMW Oracle Racing‘s attempt to derail the America’s Cup, and disregard ISAF’s jurisdiction, and their continued unsportsmanlike behaviour is unacceptable,” said Fred Meyer, Société Nautique de Genève vice-commodore. “Alinghi is ready to race on the 8 February as mandated by the 7 April 2009 court order,” he added. “We won the right to defend the America’s Cup on the water by winning the 31st and 32nd editions, we want to go racing, we do not want the outcome of the America’s Cup determined in court,” he concluded.
