America’s Cup, dichiarazione della Société Nautique de Genève

[singlepic id=2425 w=300 h=204 float=left]America’s Cup – Ras al Khaimah – Immediata giunge la replica della Société Nautique de Genève all’ottava causa intentata dal Golden Gate Yacht Club che, con un’azione senza precedenti, ha chiesto alla Corte Suprema dello Stato di New York di revocare al defender le prerogative di fiduciario dell’America’s Cup:

“Presentando la loro ottava causa contro il Defender dell’America’s Cup in due anni, Larry Ellison e il Golden Gate Yacht Club hanno dimostrato una volta ancora che la loro vera intenzione è quella di vincere il più prestigioso trofeo della vela nelle aule di giustizia piuttosto che sull’acqua. Dopo aver fallito nei suoi tentativi di aggirare i termini contenuti nel Deed of Gift, Ellison sta ora cercando di scippare la Coppa alla Société Nautique de Genève con una nuova iniziativa legale priva di ogni fondamento” ha dichiarato Fred Meyer, Vice Commodoro della Société Nautique de Genève, che ha poi aggiunto: “In qualità di vincitori di due edizioni consecutive dell’America’s Cup e di organizzatori di quella che è stata considerata la miglior edizione di sempre dell’America’s Cup in Valencia, in Spagna nel 2007, Société Nautique de Genève e Alinghi continueranno a lottare per affermare i loro legittimi diritti di promuovere lo sport nel mondo. Speriamo ancora che il Golden Gate Yacht Club voglia abbandonare questa condotta antisportiva e partecipare all’evento nelle acque di Ras Al Khaimah a febbraio del prossimo anno oppure che dia la possibilità ad altri team che vogliono partecipare, di farlo”.

Lo skipper di Alinghi Brad Butterworth ha così commentato l’accaduto: “BMW Oracle Racing dovrebbe lavare il suo comportamento antisportivo con una buona dose di acqua salata e di sole, accettando di competere per la Coppa in mare. Altrimenti si facciano da parte, lasciando spazio ad altri team che vogliono partecipare”.

“Questo ricorso è un affronto all’America’s Cup, agli Emirati Arabi, alle relazioni del nostro paese con un importante alleato e allo stesso processo penale. Nient’altro che una trovata pubblicitaria. Non c’è nulla in questa nuova causa legale che non sia già stato esaminato nelle precedenti udienze dai giudici. Fondamentalmente il Golden Gate Yacht Club non vuole regatare contro Société Nautique de Genève, dopo aver tra l’altro privato di questa possibilità altri 19 sfidanti e lasciato senza lavoro centinaia di velisti e di addetti ai lavori dell’industria nautica” ha concluso l’avvocato della Société Nautique de Genève, Barry Ostrager dello studio legale Simpson Thacher & Bartlett”.

AMERICA’S CUP, SOCIETE NAUTIQUE DE GENEVE STATEMENT
[Alinghi Press Release] Few hours later the Golden Gate Yacht Club eight legal action, Société Nautique de Genève replies with the following statement:

“By filing their eighth legal action against the defender of the America’s Cup in two years, Larry Ellison and his Golden Gate Yacht Club have demonstrated yet again that their true intention is to win sailing’s most prestigious trophy in court instead of on the water. After failing in their attempts to circumvent the terms set in the governing Deed of Gift, Ellison is now seeking to snatch the Cup from Société Nautique de Genève with a new round of baseless allegations,” said Fred Meyer, Société Nautique de Genève Vice-Commodore. “As two-time winner of the America’s Cup and organiser of what was widely considered the most successful America’s Cup event ever in Valencia, Spain, in 2007, Société Nautique de Genève and Alinghi will continue to fight for their legitimate rights in order to promote the sport of sailing around the world. We hope that Golden Gate Yacht Club will abandon this unsportsmanlike conduct and either join the competition on the waters off Ras Al Khaimah this February or let other teams who want to participate challenge for the Cup,” he concluded.

Alinghi team skipper Brad Butterworth said: “BMW Oracle Racing should clean up their unsportsmanlike behaviour with a dose of saltwater and sunshine and challenge for the Cup on the water. Otherwise they should stand aside and let other teams compete.”

“The complaint is an affront to the America’s Cup, to the UAE, to our country’s relationship with an important ally, and to the judicial process. It is just a PR stunt. There is nothing in the complaint that hasn’t been the subject of prior or pending legal proceedings. Basically, Golden Gate Yacht Club doesn’t want to race Société Nautique de Genève on the water after it disenfranchised 19 other clubs from competing in an elimination series and dislocated hundreds of sailors and participants in the sailing industry,” concluded lead counsel for the Société Nautique de Genève, Barry Ostrager of Simpson Thacher & Bartlett.
