America’s Cup, la notte dei lunghi coltelli

America’s Cup – Valencia – Secondo quanto risulta a Zerogradinord.it, quella che si è appena conclusa è stata una lunga notte per la Giuria Internazionale della 33ma America’s Cup. I giudici hanno infatti deliberato in merito alle richieste di riparazione avanzate da BMW Oracle Racing e Alinghi e le decisioni assunte sono state quasi tutte a favore del team svizzero.

Gli statunitensi, che già nella serata di ieri si erano visti respingere la richiesta relativa ai ballast, si sono visti respingere anche le mozioni riguardanti l’orario di partenza, fissato dalla Société Nautique de Genève alle 10.06, e, al tirar delle somme, anche quella relativa i limiti di vento e onde. La Giuria Internazionale ha infatti deciso che a decidere debba essere il Comitato di Regata, di fatto nominato dalla Société Nautique de Genève.

La decisione più attesa di tutte, era quella relativa al reinserimento della regola 53 (“Skin Friction”) da parte dello yacht club defender. La Giuria Internazionale ha vietato l’impiego di tecnologie tese a limitare l’attrito tra lo scafo e l’acqua, imponendo il rispetto delle leggi spagnole e di quelle internazionali relative al possibile inquinamento del mare. Va comunque sottolineato che BMW Oracle Racing aveva già dichiarato che le tecnologie utilizzate a bordo di USA sono ecocompatibili: toccherà quindi agli stazzatori effettuare le verifiche del caso.

Per quanto riguarda la gerarchia delle regole applicabili, i giudici hanno dichiarato che il Deed of Gift ha la precedenza su tutti i regolamenti ed è al Deed of Gift che si dovrà guardare per risolvere eventuali conflitti. A tal proposito la Société Nautique de Genève aveva dichiarato prioritari il Bando e le Istruzioni di Regata.

Sull’uso di radar e apparecchiature varie per rilevare le condizioni meteo si è invece raggiunto un accordo tra i team: potranno essere utilizzate a bordo dei multiscafi, ma non sui mezzi appoggio.

“Accogliamo con favore le decisioni della Giuria. Siamo fiduciosi che le regate possano svolgersi come previsto a partire da lunedi – tempo permettendo – e non vediamo l’ora di riportare questa competizione sull’acqua”.

“Queste decisioni riportano un pò di buon senso sulle regole. L’evento principe del nostro sport, cui prendono parte i migliori velisti del mondo, non dovrebbe disputarsi al fronte di condizioni meteo che anche i ragazzini degli Optimist definirebbero troppo leggere per provare la minima emozione”.

AMERICA’S CUP, THE INTERNATIONAL JURY RULES ON REDRESS REQUESTS
America’s Cup – Valencia – The night that has just ended has been very long for the International Jury of the 33rd America’s Cup. The judges have ruled on requests for redress made by BMW Oracle Racing and Alinghi.

After the decision on the ballast affaire, the International Jury has confirmed the start time for races will be at 10.06 am. The Jury also gave to Race Office Harold Bennett the discretion to use his experience and judgment on what constitutes fair and safe conditions for racing.

On the Skin Friction affaire, the International Jury has banned the use of technologies designed to limit the friction between the hull and the water if these technologies are not green and fully compliance with the Spanish and international laws relating to the possible pollution of the sea. It should however be noted that BMW Oracle Racing had already stated that the technologies used onboard USA are green and environmentally safe.

On the use of wind dectection equipments, it’s seems that an agreement has been reached: they can be used, but only onboard the multihulls.

Regarding rules hierarchy, the International Jury have ruled that the Deed of Gift has precedence over all the other rules and that the Jury will look to the Deed of Gift to resolve any conflicts. In this regard, the Société Nautique de Genève stated the priority of Notice of Race and Sailing Instructions.

“This brings some degree of common sense back to the rules. The pinnacle event in our sport, contested by the world’s best sailors, ought to allow racing in conditions that even kids in the Optimist trainer class would say were too light to be any fun”.
