[singlepic id=4351 w=300 h=204 float=left]America’s Cup – Ginevra – Continua il botta e risposta tra la Société Nautique de Genève e il Golden Gate Yacht Club che, lo ricordiamo, ha mosso dubbi sulla regolarità delle vele utilizzate a bordo di Alinghi 5. Queste, secondo gli statunitensi, violerebbero la clausola di nazionalità fissata dal Deed of Gift.
Nella lettera inviata ieri il defender, oltre a proporre un incontro davanti al presidente della Giuria Internazionale, David Tillet, il defender torna a ribadire un concetto espreso nella missiva del 27 dicembre scorso: il Deed of Gift richiede che solo l’imbarcazione – “…yacht or vessel…” – debba essere costruita nella nazione di appartenenza e non impoone alcun obbligo relativamente ai diversi componenti che sono a bordo dell’imbarcazione.
In chiusura, la Société Nautique de Genève avanza dubbi di conformità sulla stessa ala rigida recenemente installata a bordo di USA.

Le scrivo in riferimento alla vostra lettera del 27 Dicembre 2009, al breve messaggio ricevuto in risposta via mail dal vostro rappresentante Mr Ehman, al vostro comunicato stampa del 28 Dicembre 2009 e alla vostra lettera del giorno successivo che accoglieva la nostra offerta di un meeting per discutere le problematiche che avete sollevato.
Sono felice che abbiate accettato la nostra offerta per un incontro e spero che sia possibile continuare in linea con i recenti progressi che insieme abbiamo raggiunto a Sydney.
Considerato il successo del meeting di Sydney, la mia proposta è quella di incontrarsi nuovamente davanti al Presidente della Giuria Internazionale dell’America’s Cup, Mr. David Tillet.
Abbiamo parlato con Mr. Tillet che ha confermato di essere disponibile all’incontro. Lui stesso risponderà direttamente a entrambi i team per confermare una data e una sede per il meeting.
Voi avete sollevato eccezioni a proposito di vele e di altre attrezzature non meglio specificate che potrebbero essere utilizzate sull’imbarcazione che Société Nautique de Genève può selezionare per la difesa dell’America’s Cup, e lo avete fatto poco prima dell’inizio della prima regata in programma l’8 Febbraio 2010. Come già sottolineato nella nostra precedente lettera, l’imbarcazione defender di Société Nautique de Genève è costruita in Svizzera nell’assoluto rispetto dei dettami del Deed of Gift.
Société Nautique de Genève non concorda con la vostra interpretazione delle regole contenute nel Deed of Gift e osserva che il Deed of Gift richiede che soltanto l’imbarcazione (yacht or vessel) deve essere costruita nel paese d’origine, non imponendo in maniera esplicita alcun obbligo relativamente ai diversi componenti che sono a bordo dell’imbarcazione.
Se si dovesse dare seguito alla vostra interpretazione, Société Nautique de Genève avrebbe eccezioni simili alle vostre riguardo a tutta una serie di attrezzature presenti a bordo di USA. Société Nautique de Genève crede inoltre che l’armo di USA non sia conforme a quello descritto nel vostro Documento di Sfida presentato in data 11 Luglio 2007.
Si ritiene opportuno che i rispettivi dubbi siano affrontati e discussi nel corso della stessa riunione.
Una volta che avremo ricevuto conferma del luogo e della data dell’incontro, informeremo i nostri rappresentanti che parteciperanno alla riunione.

AMERICA’S CUP, SNG PROPOSE A MEETING TO SOLVE ALL OUTSTANDING ISSUES
[Source Alinghi] The America’s Cup Defender, Société Nautique de Genève, sent a letter to Golden Gate Yacht Club representatives today inviting the American Challenger to a meeting with David Tillett, the Chairman of the 33rd America’s Cup International Jury, to discuss various topics raised by both teams.
Société Nautique de Genève anticipates all issues to be resolved through discussion and expects the best-of-three 33rd America’s Cup Match to take place without delay, starting on 8 February in Valencia, Spain.
“Dear Commodore,
I refer to our letter dated 27th December 2009, a brief email message I have received in response from your representative Mr. Ehman, your press release dated 28th December 2009 and your letter of 29th December 2009 welcoming our offer of a meeting to discuss the concerns you have raised. I am pleased you have accepted our offer of a meeting, and I hope we can continue the recent good progress we have both made in Sydney.
Given the success of the Sydney meeting, I propose the meeting is again held before the America’s Cup International Jury Chairman Mr. David Tillett. We have spoken to Mr. Tillett and he can be available for a meeting. He will respond directly to both competitors to confirm a date and place for the meeting.
You have raised concerns regarding possible sails and other unspecified equipment that might be used on a yacht or vessel that Société Nautique de Genève may select to defend the America’s Cup just prior to the commencement of the first scheduled race of the Match, on 8th February 2010. As expressed in our previous letter, Société Nautique de Genève defending yacht will be constructed in Switzerland in compliance with the provision in the Deed of Gift and Société Nautique de Genève disagrees with your interpretation of this provision of the deed of gift. Société Nautique de Genève observes the Deed only requires the “yacht or vessel” to be constructed in the respective country and does not expressly impose obligations in respect of any of the separate components onboard the yacht or vessel.
Should your proposed interpretation be followed, Société Nautique de Genève would have similar concerns regarding a number of items of equipment onboard the USA. Société Nautique de Genève is also concerned that USA’s rig is not as described in your challenge documents dated 11 July 2007.
It is sensible that our respective related mutual concerns be discussed and addressed together at the same meeting.
Once we have confirmation of the date and place, we will advise our representatives that will attend the meeting.
