[singlepic id=4873 w=204 h=300 float=left]America’s Cup – Valencia – A distanza di poche ore dalla contromossa di Alinghi, che nel corso della mattinata newyorkese oltre a presentare le proprie evidenze per difendersi dall’azione del Golden Gate Yacht Club tese ad impedire al defender di usare le vele in 3DL, ha attaccato BMW Oracle Racing citandolo a sua volta per il design d’ispirazione francese del suo trimarano e per l’ala rigida, considerata non conforme al Deed of Gift, si è tornata a sentire la voce di Tom Ehman:
“Il Deed of Gift prevede che gli yachts debbano essere costruiti nel paese di origine dei singoli team. Nelle evidenze presentate ieri sera dalla Société Nautique de Genève, essi ammettono di usare vele in 3DL. I velisti di tutto il mondo sanno che il 3DL è americano, non svizzero.
Invede di dimostrare che le loro vele sono costruite in Svizzera come richiesto, le loro evidenze tentanto di aggirare il succo della questione con una lunga serie di scuse, distogliendo l’attenzione dai loro problemi con dei bizzarri attacchi contro la regolarità della nostra imbarcazione.
Nei mesi recenti le loro scuse sono state varie e hanno coperto una serie infinita di argomenti. Inizialmente sostenevano che “…le vele non facevano parte della barca”. Quindi che “…non si configurava il problema fin tanto che il match non avesse avuto inizio”. Poi che “…le vele sono costruite negli USA ma assemblate in Svizzera”. Ieri che “…se non possiamo usare il 3DL ci ritiriamo”. Ora, nell’ultimo atto legale, che “…il Golden Gate Yacht Club ha una barca nata dalla mano di un progettista francese”.
Si tratta di un’affermazione falsa e, in più, non c’è un solo punto nel Deed of Gift dove sia scritto dovem o da cgi, la barca debba essere disegnata, ma solo che la stessa debba essere costruita nel paese rappresentato dal team.
Dopo aver ripetuto più volte, e in modo erroneo, che il Golden Gate Yacht Club sta cercando di vincere la Coppa davanti alla corte, l’ultimo atto presentato dalla Société Nautique de Genève ha l’obiettivo di far squalificare BMW Oracle Racing. In più, la Société Nautique de Genève tenta di spostare avanti nel tempo la discussione in modo da poterla continuare dopo un’eventuale sconfitta in acqua.
Costruire una vela moderna è come fare una torta. Devi procurati gli ingredienti, metterli in uno stampo di forma e dimensioni definite dal velaio, farla letteralmente cuocere. Questo è ciò che succede a Minden in Nevada, dove le vele di Alinghi 5 sono costruite. Trasportare la torta in Svizzera e aggiungere qualche candelina non rende il prodotto un dolce svizzero”.

[Golden Gate Yacht Club Press Release] The Deed of Gift requires the competing yachts to be “Constructed in Country”. In the court papers filed last night by Société Nautique de Genève, they admit they are using 3DL sails. Racing sailors the world over know that 3DL sails are American, not Swiss, made.
Instead of demonstrating that their sails have been constructed in Switzerland as required by the Deed of Gift, their court papers attempt to duck the issue with a long list of excuses, and shift the focus away from their own problems with bizarre attacks on our yacht.
In recent months, their excuses have been, literally, all over the map. First, it was, “Sails aren’t part of a sailboat.” Then, “It’s not an issue until we race.” Next, “Our sails were built in the USA but assembled in Switzerland.” Yesterday it was, “If we can’t use our 3DL sails we’ll forfeit.” Now, in their latest court papers, “Golden Gate Yacht Club’s boat is a French design.”
This is untrue, and there is nothing whatsoever in the Deed of Gift that says where, or by whom, a yacht must be designed: only that it must be constructed in the country of the yacht club it represents.
After claiming repeatedly, and erroneously, that Golden Gate Yacht Club is trying to win the Cup in court, Société Nautique de Genève’s latest filing seeks to disqualify Golden Gate Yacht Club’s yacht. Moreover, Société Nautique de Genève threatens to bring further litigation after the Match if they lose to Golden Gate Yacht Club on the water.
Making a modern sail is like baking a cake. You gather the ingredients, put it in a mold of a shape and size designated by your design team, and literally cook it. That’s what takes place at the 3DL plant in Minden, Nevada, where Alinghi‘s sails were constructed. Shipping that cake to Switzerland and adding some candles does not make it “Swiss-made.”
